TERMS & CONDITIONS OF DATA USE


  • 1 INTRODUCTION:

    1. The Statistical Institute of Jamaica (STATIN) is committed to producing high quality statistics on the social, economic and environmental situation of the Jamaican people. Accurate and timely data dissemination is key to implementing and highlighting strict compliance with the mission of STATIN and the United Nations Fundamental Principles of Official Statistics. STATIN is committed to achieving excellence through the provision of timely, reliable and accurate statistics for informed decision making in order to maximize the welfare of all Jamaicans. STATIN’s Terms and Conditions outline the standards for data sharing, access, authorship, citation, and the restrictions on the use of data released by STATIN on its website www.statinja.gov.jm

  • 1.1 STATIN’s DATA ACCESS REQUIREMENTS

    1. Access to STATIN’s data is subject to the requirements set forth by these Terms and Conditions. There are two broad categories of data to which STATIN grants access: published data and unpublished data. These Terms and Conditions cover access to published data.

  • 2 DEFINITIONS

    1. STATIN’s Data. Digital data and metadata produced by STATIN, provided through the organization’s website, publications or through other media, including data and metadata derived from STATIN monitoring protocols, field observations, collections, analysis, geospatial information, all written, recorded, graphic, audio, visual and other materials in any media.

    2. Third Party Data. Digital data and its metadata provided through the organization’s website, publications or through other media, not produced by STATIN, but produced by a third party.

    3. Published Data. Data that is released by STATIN for general use via the Institute’s website, publications or other medium.

    4. Unpublished Data. Data that is released by STATIN for specific purposes and under specified terms and conditions.

    5. Data Identifier. A unique identifier created by the information system to be included with the Data for the purpose of tracking and ongoing identification.

    6. Data User. Individual to whom access to this Data may be granted, subject to acceptance of these Terms and Conditions by such individual and his or her immediate collaboration sphere, defined here as the institutions, partners, students and staff with whom such individual collaborates and to whom access must be granted in order to fulfil such individual’s intended use of the Data.

    7. Data Contact. Party designated in the accompanying metadata of the Data as the primary contact for the Data.

  • 3 CONDITIONS OF USE

    1. Licence. STATIN grants to the Data User a non-exclusive, royalty-free licence to copy, use and create derivative works from STATIN’s Data for commercial and non-commercial purposes, released through its website, www.statinja.gov.jm, subject to the terms of this Licence.

    2. Approved use. The Data User is permitted to produce and distribute derived works from STATIN’s Data subject to proper attribution. STATIN accepts no responsibility for the third party use or interpretation of the data or for inferences based on it.

    3. Intellectual Property Rights. Data users shall acknowledge that any available intellectual property rights, including copyright in the data are owned by STATIN.

    4. Attribution. The Data User agrees to offer clear attribution to STATIN for all uses and derivations of STATIN’s Data in any reasonable manner, but not in any way that suggests that STATIN endorses you or your use. The Data User also agrees to clearly indicate if changes were made to the data received from STATIN. Additionally, for data freely accessible on STATIN’s website, data users are required to provide a link to the original data produced by STATIN.

    5. Citation. STATIN’s Data are made immediately available as soon as possible after field collection; however, other quality control processes may require additional time to complete. Therefore, STATIN’s Data may undergo periodic revision(s) Thus, the Data User agrees to properly cite STATIN’s Data, including the Data Identifier, in any publications or in the metadata of any derived data products that are produced.

    6. Limitation. The non-exclusive licence provided herein is limited solely to STATIN’s Data and shall not extend to any Third Party Data, software, source code, object code or other technology or works of authorship not expressly identified herein as part of the applicable Data. All Third Party Data downloaded from the STATIN website shall be subject to separate licensing terms that are disclosed with such Third Party Data.

    7. Termination. By using STATIN’s Data, the Data User agrees to abide by the terms of this Agreement. If you fail to comply with this Licence, your rights under this Licence will terminate automatically. STATIN accepts no liability for any misuse that is caused or encouraged by the Data User's failure to abide by the terms of this Licence.

    8. Disclaimer. To protect the identity and confidentiality of persons or businesses providing information the data have been aggregated or anonymized in such a manner so as to prevent the disclosure of confidential information pertaining to any individual, household or business establishment pursuant to Section 8 (2) of the Statistics (Amendment) Act 1984.
      NOTWITHSTANDING THIS, DATA ARE MADE AVAILABLE "AS IS" WITHOUT WARRANTY OF ANY KIND, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE DATA USER HOLDS ALL PARTIES INVOLVED IN THE PRODUCTION OR DISTRIBUTION OF THE DATA HARMLESS FROM DAMAGES RESULTING FROM ITS USE OR INTERPRETATION INCLUDING ANY CONSEQUENTIAL DAMAGES, PUNITIVE DAMAGES, INDIRECT DAMAGES, SPECIAL DAMAGES OR LOST PROFITS.
